What they do is hold on to the money until everything is completed, and that is not illegal. I used to audit a number of solicitors and they have a general client account as well as their practice account. If they get very substantial amounts on behalf of a client they are obliged to open a separate individual client account to hold that money in, and pay the interest to the actual client. If it is a smaller amount (can't remember the actual amount) it goes in the general account. If they hold it for too long a time (and this is checked as part of the audit process) they have to give that client the interest he/she would have earned. I can assure you that all the solicitors I've ever acted on behalf of have behaved perfectly when it comes to client money, it just is not worth it for them not to.
I'm not sure about your individual one mate, because I'm fairly sure incapacity is not a means tested benefit, but it was changed for new claimants when Gordon Brown was still PM to ESA (Employment Support Allowance?), but I don't think that is means tested either. You'd have to pay some back if you had earnings or a pension (perhaps if part of an award was loss of earnings or pension as well).
