Given that we've seen a screenshot of a message that may or may not have been sent direct to SP's phone, I don't think there's enough of the story for us to know.

If SP had put a defamatory hashtag then perhaps...

Perhaps the only court that matters is the 'court of public opinion'. I made my own conclusions regarding the treatment of Andrew Lapping and the conduct of board. I remain bitter about the treatment of Lapping. I have made my own mind up as have many others.
